1. Overview
Neomechanical provides platform services that store and process user data. This Privacy Policy describes how we handle data and clarifies responsibilities between Neomechanical, our Customers (account owners and companies using the product), and end users.
2. Data Responsibility — Customer Liability
The account owner and company using Neomechanical are responsible for what data they provide.
- Data you provide: You decide what content, events, and user data you submit to the Platform. Neomechanical is not liable for the nature, sensitivity, or legality of that data.
- Data processing: We process data according to your configuration and our service design. You are responsible for how that processing affects your users and any downstream consequences.
- End user data: If you process data about your end users through Neomechanical, you are the data controller (or equivalent) for that data. You must obtain consent where required and comply with applicable privacy laws (e.g., GDPR, CCPA). Neomechanical acts as a processor and is not liable for your obligations to your users.
3. How We Process Data
Neomechanical processes data to deliver moderation, risk analysis, and related services. This may include automated analysis, storage, and transmission to third-party providers (e.g., AI/ML models, infrastructure). We do not sell your data. We use it to provide and improve our services. Processing may occur in multiple jurisdictions; by using the Platform, you consent to such processing where applicable.
4. No Warranty on Interpretation
Neomechanical does not warrant the accuracy, reliability, or appropriateness of our analysis or outputs. You are responsible for how you interpret and act on processed results. We hold no liability for decisions you or your systems make based on Platform outputs, including moderation actions, risk scores, or automated responses.
5. Account and Platform Data
We collect and store account information (email, name, credentials, billing details) to operate the service. Usage data (API calls, credit consumption, logs) is retained for billing, security, and support. We may use aggregated, anonymized data for analytics and improvement.
6. Third-Party Services
We may use third parties for hosting, email, payment processing, and AI/ML services. Data may be shared with them as necessary to provide the Platform. Their handling of data is governed by their respective policies. Neomechanical is not liable for third-party conduct, but we select providers with reasonable data practices.
7. Security
We implement reasonable technical and organizational measures to protect data. We do not guarantee breach-proof operation. In the event of a security incident, we will notify affected Customers as required by applicable law.
8. Data Retention
We retain data as needed to provide the service, comply with legal obligations, and enforce our terms. You may request deletion of your account and associated data; we will process requests in accordance with applicable law and our operational requirements.
9. Your Rights
Depending on your jurisdiction, you may have rights to access, correct, delete, or restrict processing of your personal data. For data about your end users that we process on your behalf, you are responsible for handling their requests; we will assist as needed within the scope of our role as processor.
10. Limitation of Liability
To the maximum extent permitted by law in all jurisdictions, Neomechanical is not liable for any harm arising from the data you provide, how we process it, how you interpret our outputs, or how your end users’ data is handled. Our liability is limited as set forth in our Terms of Service.
11. Changes
We may update this Privacy Policy. Material changes will be communicated via email or in-app notice. Continued use after changes constitutes acceptance.
